By reducing the charge to a non-alcohol offense it can ultimately be expunged. For one female client of mine, she was sentenced to a relatively short probation period and much lower fines, no classes or anything like that. You have probably heard stories about police officers following an individual until a minor traffic infraction is made. It happens all the time where police officers will follow someone thinking that they look suspicious. They don’t have reasonable suspicion to stop the driver and they will just continue to follow them until there’s some vehicle code violation and then they’ll stop them.

Oftentimes, a Minor Traffic Violation Will Lead to a DUI Investigation

There’ll be situations where officers will conduct the swarm raid or they’ll parking out six motorcycles outside of a local restaurant or bar and wait for people to leave and they’ll just send one motorcycle after each car and follow people until something happens. The infraction could be minor, such as not using a signal or not having a registration sticker on a license plate, and they’ll pull people over. They could follow you all the way home.

If police officers want to, they can follow you until there’s a vehicle code violation. If you look at the vehicle code it’s one of the thickest code books that exists. There is a multitude of reasons why they could pull you over: obstructing your windshield, obstructing your clear view, registration and equipment violations, tire pressure, not using signals, turning, speeding, driving too fast, or even driving too slow.

Ensure Your Vehicle Is in Good Condition and Up-to-Date with Any Required State Inspections

They can find any reason they want to pull you over. We have to be very careful and make sure that our cars are in perfect working order and that we don’t violate any rules of the road.

As an attorney, I don’t want anybody driving in an unsafe fashion but I also don’t want people’s rights being violated. I don’t want people being punished for something that they didn’t do.
